# PEACH PRIVACY POLICY

This Privacy Policy explains how **Peach Labs LTD**, a company incorporated under the laws of the British Virgin Islands (**“Peach,” “we,” “us” or “our”**), may collect, use, disclose and protect personal information in connection with the websites, applications, interfaces, software development kits, APIs, smart contracts, protocols, tools and other products and services made available by or associated with Peach (collectively, the **“Services”**).This Privacy Policy should be read together with the **Peach Terms of Use**, which govern your access to and use of the Services.By accessing or using the Services, you acknowledge that you have read this Privacy Policy and understand the practices described in it.

### 1. Scope

This Privacy Policy applies to personal information processed by Peach in connection with the Services. The information Peach processes depends on how you interact with the Services. Because many Peach Services are designed to operate through self-custodial wallets and public blockchain networks, Peach may process relatively limited information about users compared with traditional financial platforms. This Privacy Policy does not apply to independent third-party services, protocols or websites that may be accessed through or integrated with the Services.

### 2. Information We May Collect

#### 2.1 Information You Provide

When you communicate or otherwise interact directly with Peach, we may receive information such as:(a) your name, email address or other contact information;(b) information contained in communications, feedback or support requests;(c) account or profile information, if a particular Service supports user accounts; and(d) other information you voluntarily provide.

#### 2.2 Wallet and Blockchain Information

When you connect a wallet or use blockchain-based Services, Peach may process information such as:(a) public wallet addresses;(b) transaction hashes;(c) token balances and transaction activity;(d) smart-contract and protocol interactions;(e) blockchain network information; and(f) other information publicly available through blockchain networks. Public blockchain information may be visible to anyone and may remain permanently available independently of Peach.

#### 2.3 Technical and Usage Information

When you access or use the Services, Peach or its service providers may automatically collect technical or usage information such as:(a) IP address;(b) browser type and version;(c) device and operating-system information;(d) approximate location derived from IP address;(e) pages, interfaces, features or functions accessed;(f) timestamps and activity logs;(g) performance, diagnostic and error information;(h) referral information; and(i) identifiers generated through cookies or similar technologies.

#### 2.4 Information From Third Parties

Peach may receive information from third-party service providers and publicly available sources, including:(a) blockchain-data providers;(b) analytics and infrastructure providers;(c) security and fraud-prevention providers;(d) sanctions, compliance or wallet-screening providers; and(e) other service providers supporting the operation or security of the Services.Peach does not ordinarily collect KYC or identity-verification documentation directly as part of the general Services. Where compliance or verification measures are necessary, Peach may rely on an independent third-party provider and may receive limited information regarding the outcome of such checks.

### 3. How We Use Information

Peach may use information to:(a) provide, operate and maintain the Services;(b) facilitate transactions or interactions requested by users;(c) authenticate wallet or user interactions where applicable;(d) monitor the performance, reliability and security of the Services;(e) detect and prevent fraud, malicious activity, abuse and security threats;(f) troubleshoot errors and technical issues;(g) provide user support and respond to communications;(h) understand how users interact with the Services;(i) develop, optimise and improve products, infrastructure and functionality;(j) comply with applicable legal, regulatory, sanctions and compliance requirements;(k) establish, exercise or defend legal rights;(l) protect Peach, its users and third parties; and(m) carry out other purposes disclosed when information is collected or otherwise permitted by applicable law\.Where applicable law requires a legal basis for processing personal information, Peach will rely on an appropriate basis, which may include performance of a contract, compliance with legal obligations, legitimate interests or consent.

### 4. Blockchain Data

4.1 Public blockchain networks are generally transparent and operate independently of Peach.

4.2 Information associated with your wallet address or transactions may be publicly visible and may be collected, copied, analysed or retained by third parties.

4.3 Blockchain records may reveal information about your holdings, transactions and interactions with different protocols even where your real-world identity is not directly displayed.

4.4 Peach does not control public blockchain networks and generally cannot alter, erase or restrict information recorded directly on a public blockchain.

4.5 You should avoid including personal or confidential information in blockchain transactions unless necessary.

### 5. Cookies and Similar Technologies

5.1 Peach may use cookies, local storage, pixels or similar technologies to:(a) operate and secure the Services;(b) maintain preferences and functionality;(c) understand usage and performance;(d) diagnose technical problems; and(e) improve the user experience.

5.2 Some of these technologies may be provided by third-party analytics or infrastructure providers.

5.3 Where required by applicable law, Peach will provide appropriate notices or choices regarding non-essential cookies and similar technologies.

5.4 You may also be able to control certain cookies through your browser settings, although disabling them may affect some functionality of the Services.

### 6. Compliance and Security Screening

6.1 Peach may use blockchain analytics, wallet screening, sanctions screening, fraud-prevention and similar tools to protect the Services and comply with applicable legal requirements.

6.2 Such screening may be performed by independent third-party providers. Depending on the relevant Service and circumstances, Peach may receive information such as risk indicators, screening results or other limited information from those providers.

6.3 Peach does not ordinarily require users of the general Services to submit KYC documentation directly to Peach.

6.4 If additional verification becomes necessary for a particular Service, transaction or legal requirement, Peach will provide any additional information or notice required by applicable law.

### 7. How We Share Information

Peach may disclose information where reasonably necessary to:(a) affiliates and other entities supporting the operation of the Peach ecosystem;(b) cloud, hosting, infrastructure, analytics and technical service providers;(c) security, fraud-prevention, blockchain analytics and compliance providers;(d) professional advisers, auditors, accountants and insurers;(e) counterparties and advisers involved in a financing, merger, acquisition, restructuring or transfer of Peach's business or assets;(f) governmental authorities, courts, regulators or law-enforcement bodies where required or permitted by law;(g) protect the rights, safety, property or security of Peach, its users or other persons; or(h) another person with your consent or at your direction. Service providers are expected to process information only for the purposes for which it has been disclosed to them and subject to applicable contractual and legal requirements. Peach does not sell personal information to advertisers for monetary consideration.

### 8. International Data Transfers

Peach operates in an international blockchain and technology environment. Your information may therefore be processed, transferred or stored in countries or territories outside the British Virgin Islands or your place of residence, including locations where Peach's service providers operate. Where required by applicable law, Peach will take reasonable measures designed to ensure that international transfers of personal information receive appropriate protection.

### 9. Data Retention

Peach retains personal information for as long as reasonably necessary for the purposes described in this Privacy Policy, including to:(a) operate and secure the Services;(b) maintain appropriate business and transaction records;(c) comply with legal, regulatory, tax or accounting requirements;(d) investigate security or compliance matters;(e) resolve disputes; and(f) establish or defend legal rights. Retention periods may differ depending on the nature of the information and the purpose for which it is processed. Information recorded on public blockchain networks is outside Peach's control and may remain available permanently.

### 10. Data Security

10.1 Peach uses commercially reasonable technical and organisational measures designed to protect personal information against unauthorised access, loss, misuse, alteration or disclosure.

10.2 Such measures may include access controls, monitoring, security procedures and appropriate safeguards used by Peach or its service providers.

10.3 However, no internet, software, blockchain or data-storage system can be guaranteed to be completely secure.

10.4 Peach therefore cannot guarantee the absolute security of personal information or prevent every security incident, cyberattack or unauthorised access.

### 11. Your Privacy Rights

Depending on applicable law and your jurisdiction, you may have certain rights relating to your personal information, including rights to:(a) request access to personal information held about you;(b) request correction of inaccurate or incomplete information;(c) request deletion of certain personal information;(d) object to or request restriction of certain processing;(e) withdraw consent where processing is based on consent; and(f) make a complaint to an applicable data-protection authority. These rights may be subject to exceptions or limitations under applicable law. Peach may need to verify your identity or authority before responding to a privacy request. Certain rights may not be technically capable of applying to information recorded on public blockchain networks that Peach does not control.

### 12. Children's Privacy

The Services are not intended for persons under **18 years of age**. Peach does not knowingly seek to collect personal information from persons under 18 through the Services. If Peach becomes aware that personal information has been collected from a person under 18 in circumstances where it should not have been collected, Peach may take reasonable steps to delete or otherwise address the information.

### 13. Third-Party Services

The Services may contain links to, integrate with or facilitate interactions with independent third-party websites, wallets, protocols, applications or services. Peach does not control and is not responsible for the privacy or data-processing practices of those third parties. You should review the applicable privacy policies and terms of third-party services before interacting with them.

### 14. Changes to This Privacy Policy

Peach may update this Privacy Policy from time to time to reflect changes in the Services, technology, business practices, legal requirements or the ways in which information is processed. The latest version will be made available through the relevant Peach website or interface and will indicate the date of the latest revision. Where required by applicable law, Peach will provide additional notice of material changes.

### 15. Relationship with the Terms of Use

15.1 Your access to and use of the Services is governed by the **Peach Terms of Use**.

15.2 This Privacy Policy explains Peach's privacy and data-processing practices and does not replace or modify the Terms of Use.

15.3 If there is any inconsistency between this Privacy Policy and the Terms of Use regarding your contractual use of the Services, the Terms of Use shall govern, except to the extent applicable data-protection law requires otherwise.

### 16. Governing Framework

Peach intends to process personal information in accordance with applicable data-protection and privacy laws, including the laws of the British Virgin Islands to the extent applicable to Peach's processing activities. Nothing in this Privacy Policy limits any rights that cannot lawfully be limited or excluded under applicable data-protection law.
